Revised double taxation agreement with Austria will enter into force in 2011

Bern, 07.12.2010 - The protocol to amend the double taxation agreement (DTA) between Switzerland and Austria will enter into force on 1 March 2011. Aside from a provision on the exchange of information in accordance with the OECD standard, the inclusion of an arbitration clause was also agreed with Austria.

Today in Bern, Switzerland and Austria exchanged the instruments of ratification during a working meeting between State Secretary Peter Maurer and General Secretary Johannes Kyrle. As a result of this exchange, the Protocol of Amendment will enter into force on 1 March 2011. The provisions of the agreement will apply to assessment years beginning on or after 1 January 2012.

The protocol to amend the DTA with respect to taxes on income and capital was signed in Vienna on 3 September 2009, and was approved by parliament on 18 June 2010. The referendum deadline expired unused on 7 October 2010.
