Amendment of financial market legislation with regard to innovative business models of financial institutions

This regulatory project aims to optimise the regulatory framework for innovative business models of financial institutions.

The report "Digital finance: areas of action 2022+" instructed the FDF/SIF to review the existing regulatory framework, particularly with regard to fintech players and their business models. In doing so, the recommendations of the evaluation report on the licence in accordance with Article 1b of the Banking Act ("FinTech licence"), which the Federal Council published in December 2022, should also be taken into account. The evaluation report calls for certain elements of the licence to be amended. In addition, the latest, primarily international, developments in the area of DLT/blockchain are to be analysed from a Swiss perspective.

SIF is currently drafting a bill to amend the financial market legislation. Firstly, the aim is to examine whether the fintech licence for payment service providers (incl. stablecoin) and for providers of cryptoassets would have to be amended. Secondly, it is necessary to clarify whether further elements from the digital finance report can be implemented with the bill.

The bill is to be submitted for consultation in 2025.
