Switzerland and Tajikistan sign protocol of amendment to double taxation agreement

On 4 July 2022, Switzerland and Tajikistan signed in Bad Ragaz a protocol amending their agreement for the avoidance of double taxation with respect to taxes on income and capital (DTA). This protocol implements the minimum standards for double taxation agreements of the BEPS project.

The protocol was signed by the Head of the Federal Department of Finance (FDF), Ueli Maurer, and the Minister of Finance of Tajikistan, Fayziddin Qahhorzoda. It contains an anti-abuse clause which refers to the main purpose of an arrangement or transaction and thus ensures that the DTA is not abused. Finally, it contains a provision on administrative assistance in accordance with the international standard for the exchange of information upon request.

The cantons and the business circles concerned have welcomed the conclusion of the protocol of amendment. It still has to be approved by the legislator in both countries before it can come into force.
